• •No Professional Advice: All content, interpretations, and AI-generated readings are symbolic and reflective. They do not constitute professional advice of any kind, including medical, psychological, psychiatric, legal, financial, or investment advice, and should not be relied upon for significant life decisions.
• •No Predictive or Supernatural Claims: The App does not predict future events, guarantee outcomes, communicate with supernatural entities or spirits, or claim any metaphysical accuracy or factual certainty.
• •User Responsibility: Any actions or decisions you take based on the App's content are solely your responsibility. We are not liable for any consequences resulting from your reliance on the App.
• •Emergency/Crisis Note: The App is not a substitute for professional help. If you are experiencing a mental health crisis, emotional distress, or any medical emergency, please contact a qualified professional or emergency services immediately.

4. AI-Generated Content and Data Processing

• •Nature of AI Content: AI-generated content is produced automatically and may contain inaccuracies, errors, or omissions. Readings may differ from traditional I Ching teachings, and similar questions may yield different responses at different times. No reading should be treated as factual, authoritative, or definitive.
• •No Guarantees: We do not guarantee the accuracy, reliability, completeness, or appropriateness of any generated content. All readings are provided on an "as available" basis for reflective purposes only.
• •Data Processing & Privacy: Your input questions and card selections are processed in real-time to generate your reading. We do not retain your questions or reading history on our servers beyond what is necessary to deliver the service, we do not sell your data to third parties, and we do not intentionally use your inquiries or generated readings to train our own AI models. Third-party AI providers process your inquiries solely for the purpose of generating your requested reading in accordance with their own policies.

5. Anonymous Use, Subscriptions, and Data Storage

• •No Personal Identity Required: We do not require you to provide your real name, address, or other identifying information to use the App.
• •Credit Balance & Subscriptions: Your subscription status and credit balance are tracked on our servers. You can restore these at any time on a new or reset device using the "Restore Purchases" feature linked to your Apple ID.
• •Local Device History & Storage Limit: Your reading history is stored strictly locally on your device up to a storage limit configured by the App. Once this limit is reached, older readings will be automatically and permanently overwritten by new ones to ensure optimal app performance.
• •Data Loss & Recovery: Because we do not store your reading history on our servers, we cannot recover or sync it. If you uninstall the App, reset your device, or clear local data, this history will be permanently lost. Maintaining personal backups of any readings you wish to keep is your responsibility.
• •Limitation of Liability: To the maximum extent permitted by law, we are not liable for any loss of local data (including automated history cleanup, app deletion, device changes, or hardware resets).

6. Inquiries, Credits, and Subscription Plans

• •Free Credits: New users receive a limited number of complimentary introductory credits upon their first installation. These free credits are allocated strictly once per unique device, do not renew, and are subject to internal system limits to prevent abuse. They cannot be restored if the App is deleted, the device is replaced, or the device identifier changes.
• •Subscription Credits: Active subscribers receive a set number of inquiry credits per billing period based on their plan. Unused subscription credits expire at the end of each billing cycle and do not roll over to future periods.
• •Top-Up Credits: Additional inquiry credits may be purchased by subscribers as one-time consumables. Top-up credits are only used after your monthly subscription credits are exhausted. They roll over each month as long as your subscription remains active. Because top-up credits function as an extension of the subscription tier, they are only accessible and visible while a subscription remains active. If your subscription expires, is canceled, or lapses, access to any remaining top-up credits will be deactivated, and they cannot be viewed or utilized unless the subscription is reactivated.
• •Promotional Codes: We may occasionally issue promotional codes for extra credits. Each code may only be redeemed once per device or account.
• •Fraud and Abuse Protection: We reserve the right to suspend or adjust credit and inquiry balances if we reasonably believe fraud, technical manipulation, or misuse has occurred.

7. Subscriptions, In-App Purchases, and Refunds

• •Billing and Auto-Renewal: Payment will be charged to your Apple ID upon confirmation of purchase. Subscriptions automatically renew at the current price unless auto-renew is disabled in your Apple ID account settings at least twenty-four (24) hours before the end of the current billing period. Your Apple ID will be charged for renewal within twenty-four (24) hours prior to the end of the current period.
• •Cancellation: You may manage or cancel your subscription at any time via your Apple ID Account Settings. Cancellation takes effect at the end of the current billing cycle; you will retain subscription access until that period ends. Note: Deleting the App does not automatically cancel your subscription.
• •Restoring Purchases: Previously purchased subscriptions and your credit balance can be recovered using the App's "Restore Purchases" feature. Restoring purchases only restores your active subscription entitlement and credit balance; it does not recover locally stored inquiry history.
• •Billing Issues: If a billing or payment processing issue occurs, your access to subscription credits and inquiry features may be suspended until the issue is resolved.
• •Refund Policy: Except where required by applicable law, all purchases made through the Apple App Store are final. Because all payments are processed by Apple, we cannot directly process, approve, or issue refunds. To request a refund, you must contact Apple directly through your Apple ID purchase history or the Apple Support website. Refund requests are subject solely to Apple's terms and procedures.
• •Effect of a Refund: We do not provide partial or prorated refunds for unused portions of a billing period. The granting of a refund by Apple does not restore previously consumed inquiries or credits, and your access to paid App features will be adjusted accordingly.
• •Price and Plan Changes: We reserve the right to modify subscription plans, pricing, included inquiry allocations, or available features. Any pricing changes will apply only in accordance with applicable law and Apple's policies.
• •Consumer Rights: Nothing in these Terms limits any statutory consumer rights that cannot legally be excluded or waived under your local jurisdiction.

9. Acceptable Use and User Conduct

• •Abuse or Disrupt Systems: Interfere with, disrupt, overburden, or impair the App's operation, security, or servers. You may not use automated tools, bots, scripts, or scrapers to access or interact with the App.
• •Reverse Engineer or Clone: Attempt to reverse engineer, decompile, disassemble, or discover the source code of the App, except where expressly permitted by law.
• •Train Competing AI: Use the App, its readings, or its interpretations to develop, train, benchmark, test, or improve competing AI systems, datasets, or products.
• •Bypass Restrictions: Attempt to circumvent, manipulate, or bypass inquiry limits, subscription verifications, credit balances, or access controls through fraudulent or unauthorized means.
• •Commercial Exploitation: Copy, scrape, extract, redistribute, or systematically collect App content for commercial purposes. You may not resell, transfer, or exchange promotional codes or access credentials for value.
• •Submit Prohibited Content: Submit any prompt or content that is unlawful, abusive, threatening, defamatory, discriminatory, or infringes upon another person's or third party's intellectual property rights.

Enforcement: We reserve the right to immediately suspend or terminate access to the App for any device or token without prior notice if we reasonably believe these Terms have been breached, or if continued access risks compromising the security or integrity of our systems.

10. Intellectual Property and Licensing

• •Proprietary Rights: All proprietary content within the App—including our 64 original card designs, written hexagram interpretations, user interface (UI) design, text, branding, and underlying software—is protected by applicable copyright and intellectual property laws.
• •Public Domain Clarification: The core I Ching philosophical text and historical hexagram knowledge base used in this App are drawn from classical public domain sources. However, our unique artistic and editorial presentation of that data remains fully protected under our ownership.
• •Limited License: You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. AI-generated inquiry content is produced for your personal use only. You may not reproduce, modify, distribute, create derivative works from, republish, or commercialize any App content or card designs without our prior written permission.
• •User Feedback: If you voluntarily provide us with suggestions, ideas, comments, or feedback relating to the App, you agree that we may use, modify, and incorporate that feedback without any restriction, confidentiality requirement, or obligation to compensate you.

11. Third-Party Services

• •Independent Terms: These third-party providers operate under their own independent terms of service and privacy policies.
• •No Liability for Outages: We do not own or control these external services. Consequently, we are not responsible for the availability, security, accuracy, performance, or technical failures of any third-party provider.
• •Service Interruptions: If a third-party partner experiences an outage or technical issue, certain features of the App (such as generating inquiries or restoring purchases) may be temporarily unavailable or operate with reduced functionality.
• •Convenience Links: Any links within the App to third-party websites or services are provided solely for your convenience and do not constitute an endorsement or guarantee of those services.

12. Disclaimer of Warranties

• •AI Output Limitation: AI-generated readings and interpretations are produced automatically. We do not guarantee that responses will be entirely accurate, complete, consistent, objective, or suitable for your specific individual circumstances.
• •No Professional Advice: Readings and inquiries are provided for spiritual, philosophical, and personal entertainment purposes only. They do not constitute financial, legal, psychological, medical, or other professional advice.
• •System Availability: We do not guarantee that the App, any third-party services it relies upon (including AI processing services), or any related infrastructure will always be available without interruption or error. We do not guarantee that every inquiry will successfully generate a response, or that the App will always be free from defects, harmful components, server errors, or temporary service interruptions.
• •Device Compatibility: We do not guarantee continuous compatibility with every mobile device model or future versions of operating systems.
• •Force Majeure: We shall not be liable for any delay, interruption, or failure to provide the App or any of its features where such delay, interruption, or failure results from events beyond our reasonable control. These events include, but are not limited to, internet or telecommunications failures, cyberattacks, failures of third-party service providers, widespread AI service outages, power failures, natural disasters, acts of government, changes in applicable law, labour disputes, epidemics, pandemics, war, terrorism, or other unforeseen events beyond our reasonable control.

Your use of the App, its credits, and its inquiry features is entirely at your own discretion and risk.

13. Indemnification

• •your unlawful use or misuse of the App;
• •your breach of these Terms;
• •your infringement of any intellectual property, privacy, or other legal rights of a third party; or
• •your violation of any applicable law or regulation.

This indemnity applies only to the extent that such claims, losses, or expenses result from your actions or omissions and does not limit any consumer rights that cannot be excluded under applicable law.

14. Limitation of Liability

• •Indirect or Consequential Damages: Indirect, incidental, special, consequential, or punitive damages.
• •Financial & Operational Losses: Loss of profits, revenue, business, goodwill, opportunity, anticipated savings, or data stored locally on your device.
• •Reliance on Interpretations: Decisions, actions, or omissions taken by you or any third party in reliance upon any credit system, reading, or AI-generated inquiry interpretation generated by the App. You acknowledge that the App does not provide professional advice and you remain solely responsible for your own life choices.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the App or these Terms—regardless of whether the claim is based on contract, tort (including negligence), breach of statutory duty, or otherwise—shall not exceed the greater of: (1) the total amount you have actually paid to us through the App during the twelve (12) months immediately preceding the event giving rise to the claim; or (2) Fifty Pounds Sterling (£50 GBP), if no payments have been made.

15. Suspension and Termination

• •You have breached any provision of these Terms or Apple's App Store Guidelines;
• •You have attempted to circumvent, manipulate, or exploit inquiry limits, credit balances, or subscription controls;
• •Fraudulent, abusive, or unauthorized activity has occurred on your device or account;
• •Your use of the App poses a security or operational risk to us, our users, or our third-party infrastructure providers; or
• •Continued access may expose us to legal, financial, or regulatory liability.

Effects of Suspension or Termination: If your access is terminated due to your breach of these Terms, your licence immediately ends, access to subscription features ceases, and any remaining credits may be forfeited without refund. Termination does not affect rights or obligations that accrued before the termination date.

16. Apple App Store Legal Terms

• •No Maintenance or Support: You acknowledge and agree that Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
• •No Liability for Claims: Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including but not limited to: product liability claims, consumer protection claims, regulatory compliance claims, or any third-party claims that the App infringes intellectual property rights.
• •Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
• •Scope of License: The license granted to you for the App is strictly limited to a non-transferable, revocable license to use the App on any Apple-branded devices that you own or control, as permitted by the usage rules set forth in the Apple Media Services Terms and Conditions.
• •Compliance with Apple Policies: You must comply with all applicable Apple policies, usage rules, and App Store Terms of Service while using the App.

17. Governing Law and Jurisdiction

• •Mandatory Consumer Rights: If you are a consumer residing outside of England and Wales, you may also benefit from any mandatory provisions of the consumer protection laws of your country of residence where those rights cannot legally be excluded or waived by contract.
• •Dispute Resolution First: Before commencing any formal legal proceedings, both you and Zense I Ching Ltd agree to make reasonable, good-faith efforts to resolve any dispute or issue informally through direct discussion and negotiation.
• •Exclusive Jurisdiction: Subject to applicable mandatory local consumer protection laws, the courts of England and Wales shall have exclusive jurisdiction over any legal dispute or claim arising from these Terms or your use of the App.

18. Severability and Waivers

• •Severability: If any provision of these Terms is found by a court or other competent authority to be unlawful, invalid, or unenforceable, that specific provision shall be deemed severed from these Terms to the minimum extent necessary. The remaining provisions of these Terms shall continue in full force and effect.
• •Minimum Modification: If any invalid or unenforceable provision could be made valid or enforceable by modifying part of it, that provision shall apply with the minimum modification necessary to make it lawful, valid, and enforceable.
• •No Waiver: No delay, failure, or omission by us to enforce any provision of these Terms or to exercise any right or remedy shall constitute a waiver of that provision, right, or remedy, nor shall it prevent us from enforcing it at any point in the future.

19. Changes to These Terms

• •Notification of Changes: When we make material changes, we will update the "Last Updated" date shown at the top of these Terms. Where required by law or appropriate, we may provide additional notice of significant changes directly through the App interface.
• •Continued Use: Your continued use of the App after any updated Terms become effective constitutes your full acceptance of the revised Terms.
• •Disagreement: If you do not agree with the updated Terms, you must stop using the App and disable any auto-renewing subscriptions through your Apple ID settings.
